So it all starts with my bill. not I have a plam with att that I get unlimited data text and share a line with my wife. total my bill every month is around 200. The issue is I can go to any other provider get a better package at a lower price. So the signal is horrible in my area and its overpriced. So my wife hates her iphone (I love it) She wants to go to sprint to get a different phone and notices they have better packages. So I call Att to try and get a better package. I talk to the customer service rep who looks at my usage and tells me they cant help me. Because of my job I need to use about 1000 min a month and then i share the line with my wife. So I have A list and unlimited data which the rep reminds me if I change my plan I lose them forever. So i get transferred to the customer service that works somthing out that will eat up my rollover min in about 5 months tells me I can get an upgrade on my phone and says that they will upgrade my wifes phone even though she is not eligible yet. My bill sucks but she lowered it by about 50 bucks. (Still not lower then Sprint) I tell the rep that I need to talk to my wife and THEY suggest to call me back on monday. I say great I will be waiting..................No Call. Now I call a week later speak to sheila..Im getting their names now as I feel they do not follow through and do what they say. I go over some numbers with sheila and she is convinced that based on my usage I can drop my plan by about 40 bucks. but she tells me im not eligble to have my wifes phone upgraded. I told her that theother rep that didnt call me back said I could. she put me on hold and came back and said I could if she got it approved by a local stor in my area. I got the number for her and said I would go pick up and pay for 2 iphones today. she had me on the phone for over 30 min. I asked her to call me back after she got ahold of the store and let me know who to talk to. (Stupid me) 4 hours go by and no call back. hmmmm. So I call AGAIN. get ahold of Lance who tells me that sheila didnt make any notes about our call?!?!?! im sorry but WTF. really? so did she call the store like she said?!?!? NO! Lance then tells me that my wifes phone IS NOT Eligible for an upgrade. And he cant do anything about it. you think after this they could have made an exception. I voice my displeasure and he basically apologizes and says sorry.....Really? thats it. SO Now I get sent to the cancelation department again and am told that based on my usage dropping my plan will not work and ill go through my roll over like lightening AND I was approved for an upgrade for my wife just NOT an iphone 4?!?!!? huh? The rep Susie then tells me that I should try a different phone. the new samsung...?!?! what I think apple and steve jobs would be interested in knowing this. I cant believe they are trying to talk me out of the iphone. So in the middle of the conversation (Im on my iphone) The call drops. LMAO I cant believe it. the rep calls me back and tells me that they CANT COMPETE WITH SPRINT! So, she trys to talk me out of the IPHONE 4 for me and my wife and then tells me basically sprint is a better company. At the end of the conversation she basically tells me she cant help me and gives me a $40 credit to my bill and we leave on that note. So according to ATT I should keep an overpriced service pay full price for the new phone and sign another two year contract. All I wanted was to have my bill under 150 a month and upgraded to two new iphone 4's. instead I got the run around lied to and basically told my Sorry Sprint is better then us so we cant help you............

Hud? Basically, IndyMac Bank (now OneWest Bank), is holding some clients hostage, demanding a promissory notes and other ridicolous requests and in some cases not even responding to agents and lying to them in some cases. Each of those situations has happenned to me,and then they will proceed to foreclosure. Or at the end of the short sale that has taken 6 months or longer denying the short sale. For the life of me, I couldn’t figure out why they were doing this. What advantage could there possibly be for them to proceed to foreclosure? Read on and you will get the answer

OK this is how I figured it out. Late 2008 early 2009 I spoke with an agent in my office who did quite a bit of REO for Indymac and I asked her about any properties that she may have in the pipeline. She said they were slowing down and she had some inside info for me. I was told that indymac was going to be bought by some pretty big investors. Not only that they were going to be bought at a sweet deal. At the time I didnt really think to much of it. Well, I then ended up getting into a deal with a property in chatsworth califonrnia that represents the numbers you will see below. When I did my research I was very upset as well as you all should be as One West Bank is not the only one that has made sweet deals with the government. You see, IndyMac was taken over by the FDIC and sold to OneWest Bank in March/2009 I got into my deal in Feb 2009 and it went all the way to November. I have all documentation of the escrow clients names prommisory note to prove this. Who do you think the investors are inside OneWest? George Soros, Michael Dell, Steve Mnuchin (former Goldman Sachs executive), and John Paulson (hedge-fund billionaire). (very interesting, and they just aquired another bank in califorinia, check it out) http://www.fdic.gov/news/news/press/2009/pr09239.html

Now, listen to the Amazing deal they got from our wonderful FDIC….

What happenned was they purchased all current residential mortgages at 70% of value (70% of the outstanding loan amounts). They then purchased all current HELOCS at 58% of Value!!!

The FDIC then stepped in and guaranteed the following: ( Cant believe this) For any residential mortgages where OneWest experiences any loss, the FDIC will cover from 80%-95% of their loss. The loss is calculated using the ORIGINAL LOAN BALANCE, which is not the amount that OneWest paid for the loan. Let’s use my clients situation as an example Like i said this is a property in chatsworth California my buyers names were Brenda and Erick. Because of the tactics that the bank used after it was aquired by onewest we were not able to close on it.

The Loan Amount was $478,000, plus approximately 6 months of missed payments, for a grand total of approximately $485,200. OneWest would pays $334,600 for the loan. We have an offer of $241,000, net to OneWest. So, the math goes somthing like this.

The net loss, according to the FDIC formula is the original loan amount, minus the amount of the offer. In this case, $485,200-$241,000, or $244,200. Next, the FDIC, according to their Loss Share Agreement, writes a check to OneWest for 80% of the so-called “net loss”. So, OneWest gets a check from the government for $195,360 (.80 X $244,200).

then Add the $195,360 to the sales price of $241,000, and you get a total of $436,360 Remember, OneWest paid only $334,600 for the loan. So, OneWest puts $101,760 in their pocket PURE PROFIT! At what cost??!!?! Those are our Tax dollars. this is your government hard at work.
This is why it hurts short sales if you have not been able to figure it out yet. This is a sweet deal beciae its cheaper to just take the house back instead of do a short sale and pay two agents. That is a direct quote from the other agent!!

why would One west waste time negotiating through a Short Sale, when they can make more money letting it go to foreclosure? this is part of the reason stats on loan mods are so low. (the current stat is only 4% of people apply get the loan mod.)Why would OneWest approve a loan modification for this guy, when they can foreclose and make over $100k? And, to make it worse, they have held this loan for 6 months or more! Not a bad ROI.

What infuriates me the most is that in my particular case mentioned above, what they did was hold the seller hostage for a $75k promissory note, after they are already making more than $100k on the sale! This is their primary residence, 1st Position loan, and OneWest had NO RECOURSE! Imagine if they could make $100k, then get their note paid Talk about making some massive big bucks!

Onewest is not the only one that has done this. 50 banks have Shared Loss Agreements in place with the FDIC. Some of them are: Bank of America (this explains why there short sale process is SO bad., CitiMortgage, Wells Fargo, and the list goes on.

This entire agreement between the FDIC and OneWest can be found on the FDIC website. It’s all there for everyone to see! They have it all laid out. All of the formulas, worksheets.

Now, it’s up to us to bring it to the attention of our elected officials and the media. anf other agents Enough is enough!this is ridicluous

The FDIC has announced that it will need to start borrowing more money from the Treasure in order to replenish it’s deposit insurance fund this is the same fund being used to pay all of these banks in the Loss Share Agreements. Let me say this so all generations can understand…..WTF. Im sorry if that isnt proper eitcit but Im really upset about this. Where is the stimulus money that we were suckered into and didnt get a say in? Why is this ok. I think its time to stop being mister nice guy and let the politicians know what is going on. You have a voice. Use it tell the government you are not happy.

One west and our government is playing games behind the backs of the people of the United states with this housing crisis and someone needs to be told.

FB
Tell everyone you know about this as it goes deeper then you know. REO real estate is very corrupt and I will be posting more info about this in the future.

Frank Bernardo
www.soldin19.com
www.frankbernardo.com

Ok Here is what alot of people have been asking and waiting for.
